Website terms.
The basis on which this website is made available, and the limits of what it can be relied on for.
Acceptance
By viewing and using the mahal.co.nz website you are deemed to agree to these terms and conditions without qualification. If you do not agree to be bound by them, you must stop accessing and using the website.
We reserve the right to change these terms at any time by notifying users of the amended terms through the website. By continuing to access the website you agree to be bound by the amended terms.
These terms apply in addition to any letter of engagement or terms of engagement agreed with us if you become a client.
If you become a client, the documents governing our relationship take priority in this order: first, your letter of engagement; second, our terms of engagement; and third, these website terms. Where there is any conflict or inconsistency between them, the earlier document in that list prevails to the extent of the inconsistency. Nothing on this website, and nothing in these terms, varies or limits what has been agreed with you in writing for your matter.
This site is not legal advice
The content on this site is provided for general information only. Everything on it, including the Insights articles, is general information about how the law commonly works. It is not legal advice, it is not a substitute for advice, and it does not take account of your circumstances.
You should obtain professional or specialist advice before taking, or refraining from, any action on the basis of anything on this site. If a decision matters, get advice on your own facts before you make it.
No solicitor-client relationship
Using this site, reading its content, or sending us an enquiry does not make you our client and does not create a solicitor-client relationship. We act for you only once we have confirmed in writing that we are able to act, any conflict and client due diligence checks are complete, and terms of engagement are in place.
Accuracy and currency
The law changes. Content on this site is current at the time it is written and we do not undertake to keep it up to date. We take care with what we publish but we do not warrant that it is complete, accurate or applicable to any particular situation.
Fees and estimates
Any indication of fees or process on this site is general and does not amount to a quote. Fees are scoped and agreed in writing before work starts, in accordance with our terms of engagement.
Privacy policy and personal information
Use of the enquiry form on this website requires you to provide personal information. We maintain a privacy policy, which sets out how we handle it. You consent to the release of your personal information to us and to third parties in connection with the uses contemplated by that policy. If you have questions or comments about our privacy policy, contact us at office@mahal.co.nz.
Electronic communications and marketing
You consent to us contacting you by electronic message, including by email, in connection with any enquiry you send us and any matter we act on for you.
Where you have asked to receive them, you also consent to us sending you legal updates, newsletters, articles and invitations by electronic message. You can withdraw your consent at any time by using the unsubscribe link in any such message or by emailing office@mahal.co.nz. Withdrawing it has no effect on communications about your own matter.
You are responsible for telling us if your contact details change. Because of the nature of email we cannot guarantee that a message will arrive or that it will remain private in transit.
Accounts and client portal
We may make an account, login or client portal available on this website. Where we do, you must give accurate registration details, keep your password confidential, and not allow anyone else to use your login. You are responsible for everything done using your account.
We may suspend or cancel an account at any time, including where we reasonably believe it is being misused, where registration details are inaccurate, or where the matter it relates to has concluded. We may also withdraw a portal or account facility altogether, and we will give reasonable notice before doing so where it holds anything you need.

This website is operated by Mahal Law Limited from New Zealand. The information on it may not be appropriate or available for use in other jurisdictions. If you choose to access the website from a jurisdiction other than New Zealand, you do so on your own initiative and you are responsible for complying with the laws of that jurisdiction.

We or our suppliers own the copyright in the contents of this website, including its content, layout, design and marks. No part of the website may be distributed or copied for any commercial purpose, and you may not incorporate the material or any part of it in any other work or publication, in hard copy, electronic or any other form, without our prior written consent.
You may read, print and share the material for your own personal or internal business use. You may not frame any part of the website by including advertising or other revenue generating material, and you may not remove or alter any trade marks or logos appearing on it.
Links to other sites
The contents of this website may include links to third party materials. We are not responsible for the content of any linked site, and we are not liable for any direct or indirect loss or damage suffered by you from accessing, using, relying on or trading with third parties. Linked sites are provided only as a convenience, and the inclusion of a link does not imply any endorsement of the site or any association with its operators.
We reserve the right to prohibit links to this website, and you agree to remove or cease any link on our request.
Acceptable use
If you use the enquiry form or any other means of communication we make available through this website, you agree to use it only for lawful and legitimate purposes. You must not use it to send material unrelated to the purpose of the website, including offers of goods or services for sale, files that may damage another person’s device or software, content that may be offensive, or material or data that breaches any law, including material protected by copyright or trade secrets that you do not have the right to use. When you send us a communication, you represent that you own its content.
We are under no obligation to ensure that communications sent through the website are legitimate and we are not able to monitor them at all times. We reserve the right to remove any communication at any time at our sole discretion. Please report anything objectionable to us at office@mahal.co.nz.
Availability
We aim to keep this website available but we do not guarantee uninterrupted access. We may change, suspend or withdraw any part of the website at any time without notice.
Exclusion of liability
To the fullest extent permitted by law, we exclude all liability for any loss or damage that results from your use of this website and any services we provide through it, including all express and implied warranties and representations. We will not be responsible for errors or misstatements, or liable in contract, tort including negligence, or otherwise, for any loss or damage however caused, including indirect, consequential or special loss or damage, loss of profits, loss of data, loss of anticipated savings or loss of opportunity.
If you are a consumer using this website for non-business activities, nothing in these terms is intended to limit any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.
Indemnity
You will take all necessary action to defend and indemnify us and our directors, employees and agents against all costs, expenses and damages incurred in connection with any claim brought against us by a third party that arises from a breach by you of any of these terms.

General provisions
If at any time we do not enforce any of these terms, or grant you time or any other indulgence, we will not be treated as having waived that term or our right to enforce it, or any other term, later.
